What are Humanitarian Visas?

Humanitarian visas, also known as humanitarian parole or humanitarian visas, are special types of visas granted to individuals who have urgent humanitarian reasons for seeking entry into a country. These visas are typically issued on a discretionary basis and are intended to provide temporary relief to individuals facing exceptional circumstances

Are There Conditions or Restrictions Imposed by the Visa?

Humanitarian visa holders are typically required to comply with any conditions or restrictions imposed by the visa and may need to apply for extensions if their humanitarian need persists beyond the initial visa validity period. Failure to comply with visa requirements may result in revocation or denial of future visa applications.

What Evidence Do I Need to Submit?

Supporting documentation for a humanitarian visa application may vary depending on the circumstances but commonly includes medical records, letters from medical professionals, evidence of family relationships, documentation of persecution or abuse, and any other relevant evidence demonstrating the urgent humanitarian need.

Asylum Seekers:

Individuals who are physically present in the United States and fear persecution in their home country may apply for asylum, which is a form of protection granted to those who meet the definition of a refugee. Asylum seekers may submit their applications affirmatively with U.S. Citizenship and Immigration Services (USCIS) or defensively in immigration court if they are in removal proceedings.

Humanitarian Parole:

Humanitarian parole is a discretionary authorization granted by USCIS to individuals who have urgent humanitarian reasons for being allowed to enter or remain in the United States temporarily. This may include individuals who need medical treatment, victims of trafficking or violence, or those facing other humanitarian crises. Humanitarian parole is typically granted for a specific period and purpose and is not a permanent immigration status.

Temporary Protected Status (TPS):

Temporary Protected Status (TPS) may be granted to nationals of certain countries who are already present in the United States and unable to return to their home country due to ongoing armed conflict, environmental disasters, or other extraordinary conditions. TPS allows eligible individuals to remain in the United States temporarily and may include employment authorization.

Deferred Action:

Deferred Action may be granted by USCIS on a case-by-case basis to individuals who are already in the United States and facing compelling circumstances, such as serious illness or other humanitarian reasons. Deferred Action provides temporary relief from removal and may include eligibility for work authorization.

The Humanitarian Visa Process

Determine Eligibility

Before applying for naturalization, individuals must determine if they meet the eligibility requirements. These requirements include being a lawful permanent resident (green card holder), meeting residency and physical presence requirements, demonstrating good moral character, and meeting other criteria.

Prepare and Submit Application and Supporting Evidence

Once eligibility is determined, the applicant or their authorized representative must submit an application for a humanitarian visa to the appropriate immigration authority. This may involve completing a specific application form and providing supporting documentation to substantiate the humanitarian need for entry.

Review and Evaluation

The immigration authority responsible for processing humanitarian visa applications will review the submitted documents and evaluate the applicant's eligibility based on the humanitarian criteria established by law or policy. The authority may conduct interviews, request additional information, or perform background checks as part of the review process.

Decision and Notification

After reviewing the application, the immigration authority will make a decision on whether to grant or deny the humanitarian visa. If the visa is granted, the applicant will be notified of the approval and provided with instructions on next steps, such as obtaining the visa stamp or travel documentation.

Travel and Entry:

Once the humanitarian visa is issued, the applicant (if outside of the United States) can proceed with travel arrangements to the destination country. Depending on the type of humanitarian visa granted, the individual may be allowed to enter the country for a specified period and purpose, such as receiving medical treatment, reuniting with family members, or seeking protection.
